48 / 5 2020-11-09&10 Geneva CAB Decision 48/05 – Recommendation to SMB regarding ISO/IEC FDIS 27034-4
The CAB, noting document CAB/2034B/DC, agreed that the document ISO/IEC FDIS 27034-4 was in conflict with requirements in both the guidance document Guidance_for_CA_when_writing_standards.pdf and the ISO/IEC Directives Part 2 Clause 33, and was therefore considered to be unacceptable. CAB therefore made a recommendation to the SMB to stop the development of this standard.

48 / 6 2020-11-09&10 Geneva CAB Decision 48/06 – Detection process for CA in ISO/IEC standards
The CAB, noting document CAB/2034B/DC, and recognizing that the CA issues in the document ISO/IEC FDIS 27034-4 had been detected using the SMB/TMB/CASCO/CAB agreed process described in document CAB/1942/INF, nevertheless regretted that the document could reach the FDIS stage before being detected. CAB therefore recommended that SMB/TMB/CASCO/CAB agree to take actions to facilitate earliest detection of such issues, and tasked the CAB Secretary with providing a report to the June 2021 CAB meeting on those actions.

The CAB confirms the statement in the IEC CA Policy document, IEC CAB P01, that peer assessment, as defined by ISO/IEC 17040, is considered a fundamental pillar of the IEC CA Systems/Schemes and shall be included into all IEC CA Systems/Schemes rules, and that National accreditation (as referenced in clause 1.3 of IEC CAB P02) of CA bodies may be used as a factor in streamlining CA System assessment but shall not be mandatory.

In noting that the IECRE System had been granted an exemption, in its early stages, for using national accreditation and in noting the maturing status of the IECRE System, CAB requests IECRE to review its governance documents and modify as necessary to remove the mandatory requirement to hold national accreditation.

The CAB noted and endorsed the preliminary and supplementary annual reports given in documents CAB/2024/R and CAB/2024A/R and thanked 3 / 5 CAB/1925/DL the IECEx Chair, Mr Paul Meanwell, for his additional verbal report, and dealt with the matters for decision as follows:
1.1 In alignment with the IEC Statutes and Rules of Procedure CAB no longer endorses the Audited Accounts, but merely reviews them.
1.2 See the separate CAB Decision 48/12.
1.3 See the separate CAB Decision 48/13.
1.4 WG 11 was tasked with reviewing these rules and providing a recommendation to CAB in such a way that CAB could take a decision by correspondence in or before Q1 2021.

Additionally, recognizing that Mrs Marie-Elisabeth d’Ornano would step down at the end of 2020 after 7 years as the IECQ Chair, the CAB heartly thanked her for her long and valuable contribution and commitment to IECQ, CAB and the IEC, noting that she will continue on the IECQ Executive.

48 / 17 2020-11-09&10 Geneva CAB Decision 48/17 – IAF Resolution 2018-13
The CAB, noting document CAB/2018/R and previous CAB Decisions 47/31 & 45/46 on this issue, requested that the CAB IAF TF request the IAF to communicate within their community the fact that the IEC CA Systems’ 4 / 5 CAB/1925/DL schemes do not need exemption from IAF Resolution 2018-13 because the resolution, simply, does not apply to IEC CA Systems’ schemes. Furthermore, the TF was requested to raise the issue of the lack of a harmonization by IAF Members to the model "accreditation by schemes” (as implied in ISO/IEC 17065) rather than "accreditation by standards”.

48 / 18 2020-11-09&10 Geneva CAB Decision 48/18 – Ethically questionable products
The CAB, noting item 1.4 of document CAB/2018/R, which raised the issue of ethically questionable products and potential legal liability, tasked the CAB and CA Systems’ Secretariats in consultation with the General Secretary’s Office, with providing greater clarity on this question by defining what was meant by "ethically questionable products” and what potential liabilities (legal, reputation, etc), may be involved, and providingthis information back to CAB by, or before, the June 2021 CAB meeting. CAB advised that reference on this subject could possibly be sought from such organizations as the UN, WTO, WHO, etc, as well as from some certification bodies own in-house guidelines.

The CAB noted that the current CAB liaison to ACEE, Mr Toshiyuki Kajiya, would retire from the CAB at the end of 2020, thanked him sincerely for his many years in this liaison role, and tasked the CAB Secretariat with circulating a call for CAB Liaison to ACEE.

The CAB expressed its gratitude to the Affiliate Leader, Mr Rojas Manyame, for his verbal message and written report, CAB/2028A/R. The CAB recognized the important role of the Affiliate Country Programme which facilitates Affiliate countries’ understanding and use of IEC standards and conformity assessment services. The CAB also appreciated the value and the efforts of the ACAS programme, and was encouraged to see continued growth, from 31 to 33 to 35 countries over the last three years participating in the ACAS programme, and 21 to 24 to 26 countries having signed the ACAS declaration, as well as the widespread and growing use of the e-Learning modules.

The CAB, taking into account the comments received in CAB/1986A/CC, discussed the draft High-level guidance document proposed by CB, as given in the attachment to the Annex of CAB/1986/DC, decided to create a TF - Review & Revise High-level guidance, tasked to review & revise the draft guidance document, and to submit is recommendation to CAB at the June 2021 meeting, following which endorsement from CB would be
sought. The members named to the taskforce were Mr Imgrund, Selva, Vagdia, Zeitz, Duffy, Agius and Paulsen with Ms Sterling as Convenor.

47 / 29 2020-06-08&09 Geneva CAB Decision 47/29 — ISO CASCO proposed changes to ISO/IEC Directives, Part 2, Clause 33.
The CAB, noting the questionnaire CAB/1975/QP, and its results given in CAB/1975A/RQ, replied to the 4 questions as follows:
1. CAB did not support the deletion of “systems and bodies” as proposed in Change 1, Annex A, Circular letter N998.
2. CAB did not support the clarification of a CA scheme as proposed in Change 2, Annex A, Circular letter N998.
3. CAB did not support the addition of clause 33.4 as proposed in Change 3, Annex A, Circular letter N998.

The CAB, noting document CAB/1963/INF, thanked the IEC Coordinators in ISO/CASCO WGs for their important contribution to the representation of IEC in these working group meetings and their reporting to the CAB. The CAB therefore thanks IEC Coordinators Mr Heribert Schorn, Mr Shawn Paulsen, Mr Chris Agius and Mr David Hanlon, and strongly encouraged them to continue in this important work.

47 / 31 2020-06-08&09 Geneva CAB Decision 47/31 — IAF Resolutions, 2016-17, 2017-19 & 2018-13
The CAB, noting document CAB/1989/DV, decided to treat the
recommendations given therein as follows:
1) CAB approved the communication as an AC, issued by the General Secretary, as a standard distribution and circulated to the IEC CA community at the earliest convenience.
2) CAB tasked the Taskforce - IAF Resolutions 2016-17, 2017-19 & 2018-
13 with reviewing the IEC/ILAC/IAF Tripartite Agreement, and
proposing any changes it considered necessary to rectify this issue
and avoid such issues in the future, and to provide those proposals to CAB at its November 2020 meeting.
